Apart from the fact that our lawyers are excellent jurists, one thing is common among them – the sports passion. Within the legal service, we offer among other:
For Clubs:
- ongoing legal consultancy, for both the clubs, which act in the form of a joint stock company and an association, covering the whole outline of these entities’ functioning, including:
- corporation law, document management, partners and shareholders meetings, supervisory board and managing board meetings, changes of the articles of association and articles of incorporation, creation of physical culture associations, sports joint stock companies and sports associations and their registration in the National Court Register,
- labour and social insurance law, mainly employment of foreigners (obtaining work permits or residency visas), carrying out of transfers, preparation of transfer contracts,
- tax law, building depreciation, settlement of due real estate tax, issues connected with the settlement of costs of agreements with the sponsors, own promotional and advertising actions,
- media law and intellectual property right, among other negotiating and drawing up of sponsor agreements, violation of the rights to advertising, usage of marks deceptively similar to those which have been registered, and violation of personal rights;
- property and capital restructuring enabling clearing off debts;
- conducting disputes and pre-trial negotiations, including before courts of general jurisdiction, administrative courts, and union bodies (both domestic and foreign);
For the Competitors:
- individual consultancy at contract negotiation, including tax consultancy (optimisation of the employment form) as well as assistance to foreigners;
- assistance in asserting for claims in case of a club’s failure to realise a contract.
Experience
The Team members’ experience includes particularly the following:
- comprehensive services rendered to a first division club. Within the rendered services we conducted the process of introducing a joint stock company in place of an association for playing in the First Division (Ekstraklasa), without an problems with tax and pension authorities – it is one of the few fully successful procedures in Polish football;
- representing many players in disputes related to pursuing of payments in virtue of contracts on professional football playing before the bodies of the Polish Football Association (PZPN);
- representation of sports clubs and players, conducting proceedings before the bodies of PZPN and FIFA.
